Door de verkorte afdoening met de aan art. 81, eerste lid, RO ontleende overweging heeft de Hoge Raad er volgens het Comité onvoldoende blijk van gegeven de veroordeling door het hof te hebben onderworpen aan “a substantial review”. Het Comité overweegt dat het arrest van de Hoge Raad “did not contain any reference or assessment of the facts or evidence used by the Court of Appeal to convict the author for the murder of mr. Stein” en “did not provide adequate details of its considerations of the lawfulness and sufficiency of the facts and evidence used and the reasoning of its re-assessments”. In de visie van het Comité heeft de Hoge Raad niet kenbaar, met op de zaak toegesneden overwegingen ten aanzien van de feiten en de bewijsconstructie van het hof, doen blijken dat hij de veroordeling heeft onderworpen aan een “substantial review”. Zo bezien is eerder sprake van een motiveringsprobleem dan van een beoordelingsgebrek of een gebrek in het toetsingskader. [24] Niet de toetsing in cassatie als zodanig is het probleem, maar de wijze waarop daarvan blijk wordt gegeven in het concrete geval. Dat motiveringsprobleem is ook aan de orde bij de huidige formulering die de Hoge Raad bij de toepassing van art. 81, eerste lid, RO bezigt. [25]
