Freedom of expression constitutes one of the essential foundations of such a society, one of the basic conditions for its progress and for the development of every man. Subject to paragraph 2 of Article 10 (art. 10-2), it is applicable not only to “information” or “ideas” that are favourably received or regarded as inoffensive or as a matter of indifference, but also to those that offend, shock or disturb the State or any sector of the population. Such are the demands of that pluralism, tolerance and broadmindedness without which there is no “democratic society”. This means, amongst other things, that every “formality”, “condition”, “restriction” or “penalty” imposed in this sphere must be proportionate to the legitimate aim pursued.’

The Court (..) recalls that there is little scope under Article 10 § 2 of the Convention for restrictions on political speech or debates on questions of public interest (..).’
It is the Court’s consistent approach to require very strong reasons for justifying restrictions on such debate, for broad restrictions imposed in individual cases would undoubtedly affect respect for the freedom of expression in general in the State concerned (..).’

In artikel 359 leden Pro 5 en 6 Sv zijn enkele motiveringsvoorschriften neergelegd die de rechter ambtshalve bij de oplegging van een straf in acht moet nemen. Het in artikel 359 lid 2 Sv Pro neergelegde motiveringsvoorschrift heeft daarnaast zelfstandige betekenis. Dit voorschrift brengt met zich dat de rechter zijn beslissing over de strafoplegging nader moet motiveren als die beslissing afwijkt van een uitdrukkelijk onderbouwd standpunt van de verdediging of het openbaar ministerie.
Aan de rechtspraak van de Hoge Raad ligt ten grondslag dat de verantwoordelijkheid voor de inhoud en de motivering van de straftoemeting in het concrete geval in belangrijke mate bij de feitenrechter ligt. De Hoge Raad stelt zich daarom als cassatierechter terughoudend op bij de beantwoording van de vraag of de motivering van de beslissing over de straftoemeting toereikend is. (Vgl.
