On 10 February 2024, the Lithuanian Prison Service received a request from Vilnius Regional Court, together with a request from the Public Prosecutor's Office of Amsterdam, requesting information on how exactly the requested person would be protected from the effects of inter-prisoner violence and other negative consequences of the caste system, and the specific prison to which he would be placed, in order to enable the Amsterdam court to investigate the conditions of detention in that prison.
In all Lithuanian prisons, detainees/convicts are assessed according to the risk of violence they may be exposed to or the risk of violence they may pose, and, according to the risk identified, detainees/convicts are differentiated and accommodated in accommodation in such a way as to ensure their safety. Detainees/convicts may be accommodated in 1-2 or up to 4 persons per cell and even isolated if necessary to ensure their safety. In all prisons, various organizational measures (differentiation of detainees/convicts, allocation of accommodation, inclusion of detainees/convicts in rehabilitation programmes, work and other occupation measures) are in place to ensure the prevention of possible violent conflicts (including psychological violence) among detainees/convicts. Strengthening the competences of prison staff in the field of dynamic security in order to ensure a positive microclimate and to respond appropriately to situations that could escalate into violent conflict before it arises.
Prisoners shall be sent to a specific place of detention taking into account the length of the sentence imposed, the dangerousness and nature of the offence committed, the prisoner's health, psychosocial characteristics, age, ability to work, and the profession of the person concerned, and, where possible, the place of residence of the convicted person or his relatives, and taking into account the risk of violence and other risk factors, therefore, is not possible to predict in advance to which specific prison [opgeëiste persoon] might be sent to serve the custodial sentence imposed on him.
We also note that the conditions of detention in all Lithuanian prisons comply with the requirements of Article 3 of the European Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950 ("the Convention") and minimum international standards.
All prisoners are provided with a minimum of 3m2 of space (including furniture, but
not including sanitary facilities). Cells and living quarters are maintained, cleaned and repaired and; in general, the conditions of detention in Lithuania meet the minimum standards set by the European Union and other international organisations1.
All rooms in which detainees/convicts are held shall have windows to allow natural light and fresh air to enter. All prisons shall have a central heating system, and all cells and ether common areas for detainees/convicts shall be equipped with artificial lighting and mechanical ventilation. All prison accommodation shall have an air temperature of at least 18 °C and at most 28°C.
Sanitary and hygiene standards in prisons shall be established in accordance with the Health Safety Requirements for Penitentiary Facilities and Detention Facilities of Territorial Police Institutions approved by Order No 908 of the Ministry of Health of the Republic of Lithuania of 3 August 2015. Sanitary facilities (toilet, washbasin) for detainees and convicts in cel Is shall be separated from the general area of the cell in such a way as to ensure personal privacy. All prisoners and detainees shall have access to water at all times without hindrance. Prisoners shall be taken to the shower at least twice a week and, when conditions permit, may shower daily.
Prisoners shall be allowed between 1 and 4 hours in the open air. Prisoners usually participate in various rehabilitation programmes and measures, as well as in the work activities offered to them, studying, limited access to the Internet, and participation in organised leisure and cultural activities or events.
Detainees/convicts shall be provided free of charge 3 times a day with wholesome food that meets physiological nutritional standards (dietary· and vegetarian food is provided if necessary). In addition, detainees/convicts may purchase foodstuffs of their choice in the shops in the prison.
All detainees and convicts are covered by compulsory health insurance at state expense, and therefore have free access to all the health care services they need, just like any ether Lithuanian citizen. lt should be noted that all prisons are staffed with health professionals providing outpatient general practice (family medicine), dental and psychiatric services. If a detainee/convict needs health care services that are not available in the prison, the detainee/convict shall be transferred to a special medical unit of the Lithuanian Prison Service or to the nearest health care facility outside prison.
We assure you that if [opgeëiste persoon] is transferred to Lithuania under the EAW,
he will be detained in accordance with the requirements of Article 3 of the Convention.
