Bij de stukken bevindt zich een e-mailbericht van 7 maart 2013 van [A] , destijds werkzaam bij [bedrijf C] , dat aan onder anderen de gemachtigden van eiseres is verzonden. Dit bericht houdt in:
“As per our conversation, I wanted to briefly explain what the process was in regards to ‘product blending” in our Canadian Storage Facilities.
[bedrijf C] purchased product from many US suppliers and Canadian Suppliers whom used many different feed stocks depending on their location, availability and economics.
US suppliers are mainly producers of “SOY based” Biodiesel which have specific characteristics once processed. SME has a very low cetane number and wide range of IV levels (“Typical” result with a range of 120-140 will rarely meet EN14112). “Soy” products do have a lower CFPP (Cold Filter Plugging Point), and is priced accordingly. Sulphur is also very low due to the processing
“TREEME” which is a” plant oil” based Biodiesel and is not processed or seen in the market very often. [bedrijf C] reasoning for purchasing this “OFF SPEC” product was solely for the purpose of blending down the CFPP (Cold Filter Plugging Point) based on the contractual agreement with [bedrijf A] . The one problematic scenario with “TREEME” is the extremely high “Sulphur” content. The mentioned product would not be able acceptable in the Biodiesel market as it would not pass ASTM requirements, this is why blending is the only option.
”Fame” is simply a blend of different biodiesel produced from multiple feed stocks to either correct an “OFF SPEC” product, meet contract specifications, or when it makes economic sense.
“TME” is produced from “Tallow Based” products and pertains more to the Canadian Suppliers. “Tallow based” products have many great qualities such as a higher cetane value, lower IV and low sulphur as well. “Tallow Based” products have a higher CLOUD/CFPP(the point where the product will solidify) which is the reason the product is blended off with other feed stock based products.
Prior to the execution of the project, my colleagues and I were educated on the different feed stock based products that were agreed upon by our traders and their counter party. Contracts were in place prior to the movement of any cargo. Under North American standards we were purchasing based on ASTM Standard (with exceptions [bedrijf I] , [bedrijf J] , [bedrijf K] ) and selling based on EN 14112 Standards.
With the above stated facts in place and aware of our storage capabilities in both locations, [bedrijf C] would have to calculate the number of cars offloaded to ensure EN14112 specification was met. NO cars were ever unloaded by our terminal unless specific instruction via email, phone conversation and or fax was given. All BOLs / COAs were also required by both terminals prior to arrival and discharge. of any vehicle. If there were any discrepancy between either party, it was addressed or the ralicar,truck or vessel would not offload. Periodically, specific test such as sulphur, CFPP, IV, and water were run by our third party inspector ( [inspector] ) to provide accurate and current specs.”
