On the occasion of a visit by Taiwanese Customs to OLAF between 24 and 27.11.2014 an excel file (including imports and exports) was handed over to OLAF that covers transshipment data (linked import-export records for the Free Trade Zone) (Annex 3).

On 20.01.2015 OLAF received a CD-ROM (…) from the Taipei Representative Office in Brussels, which contained the replies given to the BOFT by the five companies that had been visited during the OLAF mission to Taiwan. These included per company, copies of commercial records (invoices, packing-lists, bills of lading), which according to these companies corresponded with sales of Taiwanees solar modules tot EU customers (Annex 4).
An in-depth analysis of these records by OLAF (comparing them with the transshipment data earlier provided by Taiwanese Customs) led to the conclusion that 4 out of 5 of the visited companies had in some way been involved in the transshipment of Chinese solar modules via Taiwan as consignments they had indicated as corresponding with Taiwanese production were merely transshipped Chinese solar modules that had been shipped via the Free Trade Zone in Taiwan to the EU. No involvement of transshipment by the company Ablytek could be established.
