- Employer is a staffing agency engaged in the business of providing employees to its clients;
- Employer has been asked by IV Groep Offshore and Energy, Papendrecht hereinafter called “Client” to provide them with the services of a Lead Piping Engineer,
- Employer will assign the Employee at Client to perform the duties and responsibilities connected to this role;
- Client shall be responsible for supervising and directing the Employee in the performance of his duties and responsibilities.
i did already tell you that we will extend it a little longer to give you more time to find another job. (…) As we will continue to pay you at least for February so that you have 1 more month to find another job… either through Fairplay or another agency.’
Following up on the email sent by my colleague (…) on Januari 27, in which the termination of your employment was initially announced as of Januari 31, I would like to formally conform that your contract with FairPlay will officially end on March 1, 2025.

agency clause’ vanuit Zuid-Afrika tot een volledig andere uitkomst leidt dan de zoekopdracht van deze term in Nederland, gaat de kantonrechter overigens (ook) voorbij. Bij deze zoekopdracht is namelijk het (in dit kader zeer relevante) woordje ‘
temporary’ uit artikel 1.5 van de arbeidsovereenkomst achterwege gelaten, zodat de juistheid van deze stelling niet kan worden geverifieerd.
