“In view of your address in file No. 780/2024/5921/314/2023 of 24.03.2025, regarding the request of the Dutch authorities, regarding the detention conditions to be enjoyed by the named [opgeëiste persoon] (born on [geboortedag] 1983, residing in [plaats 2] , sentenced to a sentence of 2 years and 11 months of imprisonment), in the event that he would be handed over in Romania, we inform you of the following:
If the person deprived of liberty is handed over to the Romanian authorities at Bucharest Henri Coandă Airport,he will initially be deposited in the BucharestRahova Penitentiary in order to undergo quarantine, for a period of 21 days, in a room that will provide a minimum space of 3 sqm.
Every person deprived of liberty during quarantine and observation is guaranteed the right to a daily walk for 2 hours. Moreover, each detainee was provided with a series of activities to choose from, thus creating the possibility to spend a much longer period outside the detention room, if he chose to participate.

Given the amount of the sentence, he will most likely serve his custodial sentence initially undersemi-open regime. At the same time, given his residence, most likely, for the beginning, he will serve his sentence inBotoșani Penitentiary.

In the event that the appointee is assigned to serve the sentence underthe open regime, he will most likely remain in the custody ofBotoșani Penitentiary.
Mr. [opgeëiste persoon] will benefit from a minimum individual space of 3 square meters for the entire duration of the sentence execution, with the exception of assignment within the open regime, during which he will benefit from 4 square meters, including the bed and associated furniture,without including the space designated for the sanitary facilities, the number of detainees being configured in relation to the area of the room. Each detainee will be provided with a individual bed equipped with the specific bedding.
Persons deprived of liberty in thequarantine and observation periodwithin the Bucharest - Rahova Prison are ensured the right to a daily walk of2 hours.
Within the semi-open regime, the doors of the rooms are open throughout the day. They have access throughout the day, based on a program approved by the unit's management, to the exercise yards equipped with specially arranged places for smoking.
Within the open regime, the cell doors are permanently open, except for the time intervals necessary for serving meals or carrying out administrative activities (organizing and conducting the roll call, ether exceptional situations). They have unlimited access to the exercise yards provided with specially arranged places for smoking.

Given the perspective of implementing the measures included in the ''Action Plan for the period 2020 -2025, developed for the execution of the pilot judgment Rezmives and others v. Romania, and the judgments delivered in the Bragadireanu v. Romania group of cases", as well as the current number of inmates held by the National Administration of Penitentiaries, following the criminal policies adopted by the Romanian state, the National Administration of Penitentiaries guarantees that, throughout the execution of the sentence, including the bed and associated furniture,excluding the space dedicated to the sanitary facilities, the detainee will benefit from a minimum individual space as follows:• 3 sq m during the quarantine and observation period;• 3 sq m during the period of pre-trial detention;• 3 sq m in case of serving the sentence in a maximum security regime;• 3 sq m in case of serving the sentence in a closed regime;• 3 sq m in case of serving the sentence in a semi-open regime;• 4 sq m in case of serving the sentence in an open regime.”
