“Then I suddenly heard a thud. I wondered what had happened. I saw the railing hanging loose. One part was hanging onto the building and the other part was loose, exactly as the picture you are showing me (nr. 81). The couch was sticking out of the opening, al little piece of it was resting on the ridge (in Dutch: richel) of the balcony.”En:
“The railing shown on picture 81 was in place before we started working. The guy inside who was holding the couch, told me that [het slachtoffer] backed up into the railing and that it gave way. When we got up there to start the move, so before the accident, one part of the railing was already missing.”Ook uit de verklaring van [getuige 3] volgt dit:
“On the picture you are showing me (nr. 81), there’s a railing visible. Before the incident the railing was still attached to the balcony right across the door. (…)”
“…the railing went away. The guy fell over. The railing was partly wood and partly metal. It was damaged because of the hurricane. Some tenants had put rope for the safety of the children.”Verderop:
“The higher part of the couch hit the railing, causing the railing to give way.”[getuige 5] heeft de val niet gezien.
“I knew [het slachtoffer] prior to the accident not well, just from on a fishing boat. I went in town to pick the guys up and they saw [het slachtoffer] outside, telling to come as well. He was just walking around, sitting by l’Escargot. [1] At that time, his mental and physical state seemed normal. He was lifting things upstairs and downstairs, bringing him to the truck.”
“He [[het slachtoffer]] told me he was going to help, but I told him no. I could smell alcohol from his mouth and clothes. The way he was moving, didn’t seem right. He insisted on helping so I said okay.”
“I could see he was drunk because of the way he walked; he was stumbling on the staircase.”
“I saw him with his head straight against the wall, in an awkward position. He was bleeding from his mouth. I could smell the alcohol coming from mouth in the [moet zijn: and the] blood.”
mental and physical state seemed normal”. Dat ontkracht dan mogelijk niet het alcoholgebruik, maar het is wel een aanwijzing dat [het slachtoffer] goed kon helpen met de verhuizing.
“De bezitter van een opstal die niet voldoet aan de eisen die men daaraan in de gegeven omstandigheden mag stellen, en daardoor gevaar voor personen of zaken oplevert, is, wanneer dit gevaar zich verwezenlijkt, aansprakelijk, tenzij aansprakelijkheid op grond van afdeling 1 zou hebben ontbroken indien hij dit gevaar op het tijdstip van het ontstaan ervan zou hebben gekend.”
