2.3Bij e-mail van 5 juni 2018 heeft [verzoeker] een e-mail gestuurd aan mevrouw [naam 1] , HR Advisor (hierna: [naam 1] ), waarin hij zijn beklag doet over zijn leidinggevende de heer [naam 2] (hierna: [naam 2] ):
“(…) I would like to bring to your attention some very concerning aspects that have been influencing me significantly during the last period.
Could you please schedule a meeting in order to discuss the topics below?
The following points are the synthesis of an extensive series of events that target core human values.
Please note that l tried to solve these aspects directly with [naam 2] without success and then I decided to bring them to your attention:
1. Harassment,
[naam 2] demands by email for timesheet completion in due time and then he notifies me for not doing it. This behaviours seems to be normal but many control numbers are not active in Open Air in due time, for example the unavoidable 1 day delay between generation and activation of a control number or if control number is not correctly set the rectification takes 2-3 days or more. Timesheets cannot be sent for approval during this period.
Another example are the plan approval cases that are forwarded to me without active control numbers or they are On Hold for extensive periods. In the correspondence system they keep the initial time stamp and although inactive [naam 2] expects to resolve them.
The main issue is that I am repeatedly notified and that responsibility is transferred to me although he is aware about the real causes and where solutions lay because I proactively informed him and admin so many times. The high repeatability character of his behaviour brings a lot of stress on my side leading to harassment.
I have recently noticed that [naam 2] has mentioned the plan above approval remarks in my PPP as well.
2. Potential discrimination,
During the 2017/2018 PPP creation, [naam 2] sent a notification letter to my home address where he highlighted that PPP was not completed in due time and that notification wilt be stored in my personal file. I was highly disappointed about his letter and its arguments.
Please note that most of surveyors were in the same situation. In consequence, I requested [naam 2] to provide me the confirmation that all surveyors received the same letter in order to eliminate any discrimination. [naam 2] has never replied to my emails.
I demand a clarification of this serious situation.
3. Asbestos contamination case [dossiernummer 1] ,
I had carried out few surveys on this vessel before the asbestos contamination was confirmed. I requested immediately to [naam 2] to cancel my surveys on both [dossiernummer 1] and [dossiernummer 2] vessels that were built simultaneously at the same location and I recommended him to wait for the investigation results first.
[naam 2] replied that I have to keep going to [naam bedrijf] , before any contamination extent was determined. His decision was shocking considering [verweerster] approach towards this topic. Happily all surveys were cancelled in the next few days as I dared to request.
My question is why this behaviour from a responsible person?
I have decided to sum up these items and bring them forward due to their tendency of being propagated. Their impact is very high and above acceptability on both professional and human sides therefore I demand a resolution as soon as possible.
The trigger for my complain was [naam 2] ’s recent remark about me being late at work: I usually come at 08.30 but due to traffic I arrived at 08.45 instead, although within the flexible working hours. Why being late? This event and the other above generated a lot of stress on my side that does not seem to be arbitrary. (…)”
