2.4Ter zake van de beëindiging van de huurovereenkomst hebben partijen de volgende berichten uitgewisseld:
- email alsmede whatsapp d.d. 30 november 2023 van [eiser] aan [gedaagde] met de volgende inhoud:
“(…)
I am writing to inform you that I would like to terminate my lease for [adres 1] .
I will try my best to help you find the next tenant and assist with viewing if needed.
(…)
If I understand my lease correctly, I am free to leave by 1/1 if I give you a one-month notice. Correct?
I hope this email is sufficient as a termination request.
(…)”
- email d.d. 4 december 2023 alsmede whatsapp d.d. 5 december 2023 van [eiser] aan [gedaagde] met de volgende inhoud:
“(…)
Hope you got my earlier email about lease termination.
Given I’ve provided you with a one-month notice, my lease will officially end at the end of this month. I will move out by the for sure.
(…)”
- email d.d. 6 december 2023 van [gedaagde] aan [eiser] met de volgende inhoud:
“(…)
I have read your email, but I have not yet received a cancellation letter in accordance with the agreement in the rental agreement.
See article 3.2. which refers to the conditions art. 19 of the general terms and conditions. I have include both for convenience.
That means that if I have received your notice of termination at het address stated in the rental agreement before the 1st of the month,
a notice period of 1 month applies.In other words, if I have received this before January 1, the rental agreement will expire on January 31, 2024.

- email d.d. 6 december 2023 van [eiser] aan [gedaagde] met de volgende inhoud:
“(…)
I will send the letter today.
(…)”
- aangetekende brief d.d. 11 december 2023 van de gemachtigde van [eiser] aan [gedaagde] waarin staat dat [eiser] de overeenkomst per mail op 30 november 2023 heeft opgezegd met inachtneming van de opzegtermijn van een maand en verder dat de mail niet aangetekend is verzonden zoals wel is opgenomen in de voorwaarden maar dat de mail wel is ontvangen en gelezen.
