08-09-2024If the work – within 1 week after this Temporary Employment Contract has ended – is continued by the Employee without any objection after the end date referred to above, a new temporary employment contract will always be automatically concluded between the parties under the same conditions as this Temporary Employment Contract, and for the duration of a minimum of four weeks and a maximum of eight weeks, unless:
c. The client is no longer able or willing to hire the Employee for any reason other than illness or incapacity for work and therefore terminates the assignment, in which case this Temporary Employment Contract shall terminate immediately by operation of law (the temporary employment clause in accordance with Section 7:691(2) of the Dutch Civil Code and Article 15 of the CLA).
You started working in week 31. So you have to count from the first week. So 31, 32, 33 and 34 are the 4-weeks. You signed up for 32 hours per 4 weeks, which does indeed mean that they are spread over 4 weeks. The moment you have already worked 32 hours within those 4 weeks, you are not entitled to any additional payment. As you have already worked 37,50 hours in week 31, you have already reached the 32 hours for weeks 31, 32, 33 and 34. You are therefore not entitled to any payment.

3.Het verzoek en het verweer
- € 5.087,- aan achterstallig loon (garantie-uren) inclusief 10,33% vakantie-uren en 8% vakantiegeld te vermeerderen met de wettelijke verhoging en wettelijke rente,
- € 136,- aan immateriële schadevergoeding,
- € 540,- aan buitengerechtelijke- en administratiekosten,
- de proceskosten,
- de transitievergoeding wegens onrechtmatige beëindiging,
- de billijke vergoeding wegens kennelijk onredelijk ontslag,

5 augustus 2024 in ieder geval geen werk heeft aangenomen.
