4.3.Bij die beoordeling staat voorop dat voormelde overeenkomsten geen melding maken van verplichtingen van WLP inzake promotionele activiteiten. Volgens [eiseres] zijn echter herhaaldelijk dergelijke activiteiten toegezegd. In dat verband heeft zij, onder verwijzing naar een mailbericht van WLP van 10 augustus 2010 (productie 8 bij dagvaarding), gesteld dat (zie punt 12 van de dagvaarding) “de start van de promotie al in augustus 2010 was beloofd”.
In de betreffende mail is het volgende opgenomen:

As promised I would send you information about the promotion of both your books.
First of all, in annex you will find the flyer (A5, two-sided) that can be used for either digital promotional purposes, or, printed, to ship to our libraries/bookstores/agents. Please be so kind to take a good look at it, and to suggest changes if needed. Note that adding much more text is not possible, so I cut up the information you sent me before. Note that we still have to add the cover pictures, once produced.
For your books, we have the following promotional activities in mind:
Digital
- Promoting the book(s) in our newsletter to our regular customers; libraries, bookstores and agents (note that our US agents will incorporate the information in their own materials)
- Promoting the book(s) to specific customers interested in the topic (subscribers to our newsletter)
- Compile a list of organisations and persons that really need to see this book/these books (together with the author)
- Making pre-order (and order) possible on our website
- Sending paper flyers to our US and German agents and the Netherlands’ and Belgium’s largest bookstores
- Sending you flyers so you can promote the book on conferences and so on
- Compile a list of journals to send the book to for review (together with the author!)
- Place an ad in the Dutch Tijdschrift voor Consitutioneel Recht (Consitutional law review)
- Take the book to conference we sponsor to show the book to a broader audience
- Putting the book in our yearly catalogue (if available)
- Send the book to the Dutch Royal Library for their archive
