Op 2 september 2019 heeft [eiseres] een gesprek gehad met [naam bestuurder] , bestuurder van CustomerGauge, waarna [naam bestuurder] bij e-mail onder meer het volgende aan [eiseres] heeft bericht:
“(…) you expressed disappointment with how your direct manager, [naam manager] , handled your contract renewal in a timely manner. You asked for a talk about your annual contract coming up for renewal two months before the expiration date, on July 9th, and you claimed you had to remind him on several occasions to prepare and have time for you on this. (…)
I understood from you that the financial part of what was offered in the new, indefinite, contract was disappointing. We offered you a €60k salary, a €10k increase from when you joined, with our commitment to review again as you grew in your role. Also we offered you a senior CSM level title (…).
You asked for a €75k salary in your talks with [naam manager] , and you mentioned to me that this was based on an offer of €85k you were mane recently. I confirmed to you that this was not something we could match today. (…)
At this stage, you mentioned that your salary data was based on your interviewing with other companies, with one in particular, AskNicely, which is a direct competitor to CustomerGauge. Further, if I understood you correctly, you have been offered a role at Ask Nicely to build the European CSM team. (…)
As this is a direct competitor of CustomerGauge I do need to remind you of your obligations under the CustomerGauge Confidentiality Agreement in your Contract of Employment. Also, you are aware that Customer Gauge has a 12-months non-compete clause. (…)
Just to be clear, you are free not to sign this new offer (…). I hope this will not be the outcome, of course, but nonetheless our non-compete clause will stay in place as is, in your current and new employment contract. (…)”
