1.Het verloop van de procedure
- het inleidende verzoekschrift met producties bezorgd ter griffie op 7 september 2018;
- de conclusie van antwoord van 14 mei 2019;
- het comparitievonnis van 28 mei 2019;
- de comparitie van partijen van 1 oktober 2019;
- de conclusie van repliek van 29 oktober 2019 met producties;
- de conclusie van dupliek van 21 januari 2020.
Upon the initiative of Seller a Foundation(…)
will be established, which Foundation will be the owners’ organization for the owners of the subdivision of Seller (“the owners”) which Foundation will be responsible for the maintenance of the roads and other common facilities, the control over the observing by the owners of the restrictions, the approval of the building plans once taken over from Seller and will provide services to or on behalf of the owners or will serve such other purposes or will have such other tasks as will be vested in the Foundation by the owners of the subdivision.------------------------------------------------
the services provided by the Foundation to the participants;---------------
the maintenance of the common grounds, roads and other infrastructures and facilities that have been or may be transferred or entrusted to the Foundation, including the long term reservation for such maintenance as deemed necessary by the Board;-----------------------------------------------------
other costs of the Foundation to be reasonably expected.----------------------
The Foundation dues may be raised or lowered by resolution of the Board if and when the Board deems such adjustment necessary, respectively responsible in view of the long-term obligations of the Foundation towards the Participants.-------------------------------------------------------------------------------

If the Foundation dues or a special assessment remain unpaid, in whole or in part, during one (1) months after the amount has become due and payable:---
A fifteen percent (15%) surcharge to the balance due shall be added by the Board to all indebted quarterly Foundation dues and /or the assessment;---------------------------------------------------------------------------
The Board may retain any funds to the defaulting Participants, that may have become payable since the date of default, until al indebted contribution(s) and surcharges thereon have been paid.-----------------------

4.De beoordeling
in dit gedingvanuit te gaan dat [eiseres] de bewuste Foundation is ten gunste van wie het beding tot stand is gekomen.
