Bij brief van 8 augustus 2023 van [Verzoekster] aan [Verweerder] is [Verweerder] met behoud van loon geschorst. In deze brief is het volgende vermeld:

Before you left for Colombia, you have behaved in an unacceptable manner towards management, whereby you also verbally insulted the owner and management. Your behavior was such, that it warranted an immediate dismissal. For reasons of your own, you have expressed that you did not want to work with [VBA] anymore and that you resigned.
As we were also of the opinion that with your behavior, we did not see you working with the company anymore, we have made you an offer to mutually terminate the working agreement. You have refused to sign this.
After the way you have behaved towards management and the owner of the company and expressed yourself, we do not want to continue the working agreement with you. The company has therefore decided to request a dissolution of the working agreement with the Court of First Instance of Aruba.
You are therefore notified that you are put on paid leave, as of August 9, 2023, pending the outcome of the dissolution case in Court.
We are offering you a last chance to accept the settlement offer as presented to you, until August 9, 2023 at 16.00 hours. If the offer is not accepted by that time, we will proceed with the dissolution process in Court.“
