2.8Naar aanleiding van voormelde controle heeft Eco [naam verzoeker] op 7 mei 2019 geschorst voor het verrichten van onderzoek. Vervolgens heeft Eco [naam verzoeker] bij schrijven van 15 mei 2019 (hierna: de ontslagbrief) per die datum op staande voet ontslagen. De ontslagbrief vermeldt onder meer het volgende:

On Monday May 6, 2019 Management performed a check during a group lunch event taking place at Moomba Beach. During this check, Management noticed several violations committed as described below.
1. You allowed (five) staff members (including yourself) and one security officer to sit down at a table within view of the guests and/or to order drinks which were to be placed on the bill/account of the client without any approval from Management. The charges were not authorized and/or are against company policy.
2.You told the restaurant manager to lower our guarantee from 36 meals/guests to 24 guests and to charge ECO DMS for 30 meals. The group had a total of 24 guests on site and five staff members and one security guard.
3. You had nobody monitoring the lunch and/or area where the guests were seated. You also were seen coming out of the restaurant with a plate of food ready to eat.
4. The company policy is that only after the lunch or dinner event is over and the guests have left, you are allowed to get a plate of food “to-go” if there is any leftover food.
5. As per the employment contract and the law you are required to work during work hours and follow the instructions of your employer and/or superiors and/or comply with your tasks/responsibilities and procedures. You have repeatedly failed to comply with these requirements, which had led to different disciplinary measures.
6. Your performance in the past has led to at least six disciplinary measures for the failure to follow the employment contract and/or rules and regulations of the company. These are:

7. As a result of the written warnings, issues mentioned above and performance evaluations in the past, you have been given numerous chances to adapt your behavior on how to comply with the employment contract and/or your responsibilities as mentioned above. Despite all these warnings, you have not corrected your behavior or attitude accordingly.
8. The facts outlined above 1 through 7 individually and/or collectively are the reasons why we have lost all trust in you and why your employment is hereby terminated effective immediately, as they are considered as theft, fraud or embezzlement or dishonest actions by you. This given how you mishandled a customer’s account and/or company records in a way that is against the standards of ethics & integrity we expect from our employees and our code of conduct, especially for someone in your position.
9. To prevent any misunderstanding Eco (…) would like to make clear that your employment would also been terminated effective immediately, had only one of the aforementioned actions take place, even if they don’t qualify as theft, fraud or embezzlement.
